Recent legislative changes have once again given momentum to Portugal’s short-term rental (Local Accommodation – AL) market. With the lifting of restrictions, the repeal of penalties, and the restoration of autonomy to municipalities, the sector is regaining stability and attracting new interest—at a time of growing demand for both rental housing and tourism. With Decree-Law 76/2024 of 23 October, many of these restrictive measures were revoked: the suspension of new AL registrations was lifted; the expiry and mandatory renewal of licenses were repealed; the transferability of licenses in the event of sale or change of ownership was reinstated; and the extraordinary contribution applied to AL properties was eliminated. In addition, taxation was once again aligned with that of other properties, easing the tax burden on owners. With these changes, municipalities regained the authority to regulate AL locally, including the ability to define “containment areas” or “sustainable growth zones”.
For the real estate market, this renewed legal stability restores confidence among owners and investors, encouraging those seeking properties with income potential through AL. At the same time, continued pressure on the traditional rental market and the ongoing housing crisis are sustaining strong demand for income-generating properties, making AL an attractive option for investors and property owners alike.
